1. Agreement to these terms
These terms of use (the “Terms”) form a legally binding agreement between you and VulnXperts Consultancy W.L.L., a company established in the Kingdom of Bahrain whose address is Building 2648, Road 5720, Block 257, Amwaj, Bahrain (“VulnXperts”, “we”, “us” or “our”). Vikax is a product of VulnXperts. The Terms govern your access to and use of the Website.
By accessing or using the Website, you agree to be bound by the Terms. If you do not agree to them, you must not use the Website.
If you use the Website on behalf of an organisation, you confirm that you are authorised to accept the Terms on its behalf.
2. Definitions
In these Terms:
- “Content” means all text, graphics, illustrations, product screens, sample data, software code and other material made available on the Website;
- “Feedback” means any comment, suggestion or idea about the Website or the Product that you send to us;
- “Forms” means the contact form and the demo scheduler on the Website;
- “Marks” means the Vikax name, the Vikax seal and any other trade mark, logo or service mark shown on the Website;
- “Product” means the Vikax product and any related service that we provide under a Product Agreement;
- “Product Agreement” means a separate written agreement between us and a customer that governs the use of the Product;
- “Submission” means any information that you send to us through the Forms, or by email in connection with the Website;
- “Website” means the website at vikax.app, including its pages, the Forms and the Content; and
- “you” and “your” refer to the person who accesses or uses the Website and, where that person acts on behalf of an organisation, to that organisation.
Headings are for convenience only and do not affect the interpretation of these Terms. The word “including” is illustrative and does not limit the words that precede it.
3. The Vikax product
These Terms apply only to the Website. They do not grant you any right to access or use the Product, which is made available only under a Product Agreement. If there is a conflict between these Terms and a Product Agreement in relation to the Product, the Product Agreement prevails.
4. Eligibility and use of the website
The Website is intended for people acting in a business or professional capacity on behalf of an organisation, and it is not directed at children. You may use the Website only if you have the legal capacity to enter into a binding agreement under the law that applies to you.
Subject to your compliance with these Terms, you may access the Website, read the Content and use the Forms for their intended purpose, which is to contact us and to book a demonstration of the Product.
5. Information on the website
The Content provides general information about the Product and about testing, releases and change in production. Each page describes the Product as it stands on the date on which that page was published or last updated.
Product screens shown on the Website are illustrations populated with sample data. They do not show any customer's data.
The Content does not constitute a security assessment of your applications or professional advice about your systems. You should obtain advice appropriate to your circumstances before you act on any Content.
Nothing on the Website constitutes an offer capable of acceptance. Prices and conditions are set out only in a quotation and in the Product Agreement.
6. Acceptable use
When you use the Website, you must comply with all laws and regulations that apply to you. You must not:
- use the Website for any unlawful or fraudulent purpose, or in breach of these Terms;
- overload, disrupt or impair the Website, its server or the Forms, or interfere with any other person's use of the Website;
- attempt to gain unauthorised access to any part of the Website, its server or any connected system that is not made available to you;
- introduce any virus, malware or other malicious or technologically harmful code or material, including through a Submission;
- scan, probe or test the vulnerability of the Website or any connected system, or breach or circumvent any security or authentication measure, without our prior written permission;
- use any robot, spider, scraper or other automated means to access, copy or extract the Website or the Content, except as permitted below;
- decompile, disassemble or reverse engineer any software on the Website, except to the extent that the applicable law expressly permits it; or
- impersonate any person, or misrepresent your identity or your affiliation with any person or organisation.
Search engines and similar crawlers may index the Website to the extent permitted by our robots.txt file. Any other automated access to, or copying of, the Website requires our prior written permission.
7. Submissions through our forms
When you make a Submission, you must provide accurate information about yourself. You may add a guest to a demonstration booking only if that person expects the invitation. You should send us only the information we need to respond to you, and you must not include in a Submission any confidential or sensitive information about your systems.
The Forms are provided for enquiries to us. You must not use them to send advertising, promotional material or any other unsolicited communication. Our server limits how often the Forms can be used from a single connection, and we may refuse, disregard or delete any Submission that breaches these Terms.
You are responsible for your Submissions, and you confirm that you are entitled to provide them to us, including the email address of any guest you add. We process personal data contained in Submissions as described in our privacy policy.
If you send us Feedback, you grant us a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to use it for any purpose, without any obligation or compensation to you. This licence does not extend to personal data, which we process only as described in our privacy policy.
8. Reporting a security issue
If you discover a security vulnerability in the Website while using it in accordance with these Terms, please report it to hello@vikax.app, which is the contact named in our security.txt file. Reporting a vulnerability does not authorise any further testing of the Website or of any connected system.
9. Intellectual property
The Website, the Content and the Marks are owned by VulnXperts Consultancy W.L.L. or its licensors and are protected by intellectual property laws. Except as expressly set out in these Terms, no right or licence is granted to you in respect of them, and all rights not expressly granted are reserved.
We grant you a limited, non-exclusive, non-transferable and revocable licence to access and view the Website and to:
- print or save copies of pages for your own reference;
- quote short passages of the Content, provided that you name Vikax as the source and link to the page concerned; and
- reuse the product vocabulary and the sample data shown on the Website when you describe the Product.
Any other use of the Website, the Content or the Marks requires our prior written permission.
You must not use the Marks in any manner that suggests that we endorse, or are affiliated with, you or your products or services.
10. Third-party websites and services
The Website contains links to websites operated by third parties, including Google, Zoho, Microsoft and our social media profiles. We do not control those websites, and we are not responsible for their content, their availability or the manner in which they handle personal data. A link does not constitute an endorsement. Your use of a third-party website is subject to that website's own terms and policies.
The contact form is protected by Google reCAPTCHA, and the Google Privacy Policy and Terms of Service apply to that service. Demonstration calls are held on Microsoft Teams.
12. Availability of the website
We may change, suspend or withdraw all or any part of the Website at any time. We do not guarantee that the Website, or any page or Content, will always be available or uninterrupted, and we are under no obligation to update it.
We may correct any error, inaccuracy or omission in the Content at any time.
13. Disclaimer of warranties
We endeavour to keep the Content accurate and to correct errors when we become aware of them. However, the Website and the Content are provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, conditions and representations, whether express or implied, including any as to accuracy, completeness, currency, fitness for a particular purpose or non-infringement.
In particular, we do not warrant that the Website will be uninterrupted or free of errors, or that it will be free of viruses or other harmful code.
14. Limitation of liability
To the fullest extent permitted by law, we shall not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising out of or in connection with your use of, or inability to use, the Website, or your reliance on any Content.
Without limiting the paragraph above, we shall not be liable for any loss of profit, revenue, business, data or goodwill, or for any indirect or consequential loss or damage.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the applicable law, including liability for fraud.
15. Indemnity
To the extent permitted by law, you shall indemnify us against all claims, liabilities, losses, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with your breach of these Terms or any Submission you make, including any claim by a third party that a Submission infringes its rights.
This section does not apply to the extent that you use the Website as a consumer.
16. Suspension and termination of access
These Terms apply for as long as you use the Website. We may suspend or restrict your access to all or part of the Website or the Forms, without notice, including by blocking connections from which the Website is misused, if we reasonably believe that you have breached these Terms or that doing so is necessary to protect the Website, our systems or other users.
The sections entitled “Intellectual property”, “Disclaimer of warranties”, “Limitation of liability”, “Indemnity”, “Governing law and jurisdiction” and “General provisions” continue to apply after your use of the Website ends.
17. Changes to these terms
We may revise these Terms at any time. The date at the top of this page shows when they were last updated, and the revised Terms apply to your use of the Website from that date. We encourage you to review these Terms each time you use the Website. If you do not agree to the revised Terms, you must stop using the Website.
18. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain have jurisdiction to settle any such dispute or claim.
If you use the Website as a consumer, you retain the benefit of any protection afforded to you by the law of the country in which you reside that cannot be excluded by agreement.
Before commencing any legal proceedings, please write to us so that we can attempt to resolve the matter.
19. General provisions
- Entire agreement. These Terms constitute the entire agreement between you and us in relation to your use of the Website and supersede any prior arrangement in relation to it. They do not affect any Product Agreement.
- Severability. If a competent court finds any provision of these Terms invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
- No waiver. If we do not enforce, or delay in enforcing, any provision of these Terms, that does not constitute a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms to another organisation.
- Events beyond our control. We shall not be liable for any failure or delay in performing our obligations under these Terms that is caused by events beyond our reasonable control.
- Relationship. Nothing in these Terms creates any partnership, joint venture, agency or employment relationship between you and us.
